These Terms of Service ("Terms") govern your access to and use of LightDay, a cloud-based salon and clinic management platform provided by Obsessive Software Ltd ("Company", "we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using LightDay, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using our services on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of Service
LightDay provides cloud-based software for managing salon and aesthetics clinic operations, including but not limited to:
- Appointment scheduling and diary management
- Client records and treatment history
- Online booking functionality
- CQC compliance documentation (for clinics)
- Contraindication checking
- Business reporting and analytics
- Staff management and leave planning
3. Account Registration
To use LightDay, you must create an account by providing accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised use
- Ensuring all users within your organisation comply with these Terms
4. Subscription and Payment
4.1 Free Trial
New users receive a 14-day free trial with full access to all features. A valid payment method is required to start the trial. You will not be charged during the trial period.
4.2 Subscription Fees
After the trial period, your subscription will automatically convert to a paid plan. Salons are charged £59.99 per month and aesthetics clinics are charged £69.99 per month. Additional locations are available at reduced rates: £40/month for salons and £50/month for clinics. All prices are in GBP and exclusive of VAT where applicable.
4.3 Payment Processing
Payments are processed securely through Stripe. By providing your payment information, you authorise us to charge your payment method for the subscription fees.
4.4 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access until the end of your current billing period. No refunds are provided for partial months.
5. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Attempt to gain unauthorised access to our systems
- Transmit viruses, malware, or other harmful code
- Interfere with the proper functioning of the service
- Use the service to store or transmit content that is defamatory, obscene, or harmful
- Resell or redistribute the service without authorisation
6. Your Data and Content
6.1 Ownership
You retain all rights to the data and content you upload to LightDay. We do not claim ownership of your client records, business information, or other content.
6.2 Licence
By using our service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the service to you.
6.3 Data Protection
You are responsible for ensuring you have appropriate lawful bases and consents to process your clients' personal data. You act as the data controller for client data, and we act as the data processor on your behalf. Please see our Privacy Policy for more details.
7. Intellectual Property
LightDay, including its software, design, features, and content, is the property of Obsessive Software Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
8. Service Availability
We strive to maintain high availability of our service but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience downtime. We will endeavour to provide advance notice of planned maintenance where possible.
9. Limitation of Liability
To the maximum extent permitted by law:
- The service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
- We are not responsible for any loss of data, profits, or business opportunities
10. Indemnification
You agree to indemnify and hold harmless Obsessive Software Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.
11. Termination
We may suspend or terminate your access to the service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, you will have 30 days to export your data, after which it may be deleted.
12. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through the service. Continued use of the service after changes constitutes acceptance of the modified Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
